Personal Injury Protection Issues

Since January 1, 2008 automobile insurance companies pay Personal Injury Protection (PIP) claims based upon a fee schedule. Instead of paying the straight 80% of the billed amount, they pay 80% of the allowed amount per the fee schedule. The difference between the billed amount and the allowed amount cannot be billed to the patient.

If you have a personal injury case that involves PIP payments for your own medical care via your auto policy pay extra attention to be sure you are not being balance billed outside of the fee schedule.
