Truck Safety is No Accident

Commercial Carriers operate thousands of trucks commonly called 18 wheelers on our roads 24 hours a day carrying approximately 70 percent of the goods we consume or export. With this commerce comes responsibility which is linked together much like the links of a chain. Each measure of safety is a link and if one of the links is not strong the chain breaks. Lack of safety inspection of equipment by drivers is a critical link and can cause deadly consequences if not done properly. A fully loaded truck at 80,000 pounds going 70 miles an hour that experiences a failure is at best a disaster for the trucking company and its property, and often worse, resulting in the serious injury or death of innocent drivers and passengers. Each driver of a commercial vehicle is required to conduct a straight forward and thorough safety check. Failure to check and maintain brakes or adequate tire air pressure for instance causes thousands of crashes each year. The securing of a trucks cargo or load is critical to safety as is the adherence of traffic regulations and work hour requirements which prevent driver fatigue.

Preventable Medical Errors Kill and Injure

Hospitals, out patient surgery centers, nursing homes and rehabilitation facilities across our country kill over 100,000 people each year due to preventable medical errors and many more thousands of patients suffer life altering permanent injury. Surgical errors are more common than one would think. Medical experts advocate actually writing on the particular limb or location of the surgery with a waterproof marker "site marking" as a safeguard to having the appropriate surgery. The pre- surgical paperwork should also be carefully reviewed and corrected if necessary. Medication errors also claim lives due to the incorrect medication being administered or the incorrect dose given. Both can harm and often kill. It is extremely helpful to have a trusted family member or friend accompany the patient so that treatment and proposed treatment is monitored. Recently Actor Dennis Quaid has brought medical errors to the media's attention after his twin daughters were incorrectly given massive doses of Heparin a blood thinner that nearly killed them. His family's experience is chronicled in a 60 minutes segment attached below.

Awareness of Vehicle Recalls is Critical to Your Safety

Faulty cars and trucks claim lives or cause life altering injury virtually everyday in this country. We all have heard about Firestone tires separating and causing rollovers, Ford Explorer and Mercury Mountaineer SUV's improperly engineered causing terrible crashes and non deployment of airbags which we rely on to protect us. We see the tragic results of defects all the time. Often, vehicle or equipment manufactures are reluctant to notify us of these conditions because it costs money to fix the problems they cause. Rather than prevent a tragedy they sometimes would rather deal with the results on a case by case basis. It is critically important to be aware of your vehicles recall notices or to report problems you are experiencing. The Public Citizen web site is a good source of information providing up to date recall notices and links to report problems with the make and model of your vehicle. Please see this link to review recall information and history on most makes and models of cars and trucks.

Engine Fires Force Ford Recall After Deaths and Injury

Engine Fires in Ford Motor Company trucks and SUV's have triggered a massive recall ordered by the National Highway Transportation Safety Administration (NHTSA). The recall deals with a faulty cruise control deactivation switch which can cause engine fires in gasoline vehicles. The defective switch has caused numerous fires when the engine is turned off and the switch attempts to deactivate cause the fuel to ignite. The fires are responsible for at least 3 deaths and hundreds of serious injury. Ford has attempted to address the dangerous defect by offering to disconnect the cruise control since repair parts will not be widely available until June 2008. The vehicles recalled are the 1993 -2004 F 150 trucks, 1994 -2002 F 250 through F 550 Super Duty trucks and 1998 - 2001 Ford Explorer and Mercury Mountaineer SUV's. If you are a victim of this defect it is vitally important to make sure the vehicle is preserved so that it can be used as evidence to prove the cause of injury.

Some Women Wait Too Long for Joint Replacement Surgery

According to an article published in late 2007 by University of Delaware researchers in The Journal of Bone & Joint Surgery, some women may be waiting too long to request knee replacement surgery. For years, doctors have recommended to patients that they delay surgery as long as possible. For many, this means delaying surgery until the pain becomes so great or the impairment so significant that they can hardly walk.

In the University of Delaware study, women were waiting even longer than men and had greater levels of dysfunction before deciding to undergo surgery. The problem this creates is that, if a woman waits too long to have the surgery, she is less likely to regain full mobility after the surgery. This is because the level of post-surgery function in the knee joint is related to the pre-surgery level of function. For those considering knee replacement surgery, it is important to keep this in mind.

River Health is Vital to Florida

Our firm is proud to have an active role in the litigation surrounding the water withdrawal scheme endorsed by the St. Johns River Water Management District (SJRWMD). The St. Johns Riverkeeper organization formed a legal board which is tasked with protecting the river through enforcement of the law and to assure the public that the various governmental agencies carry out their mission. Unfortunately the SJRWMD has miserably failed and is attempting to allow this precious resource to be pillaged by political and industrial interests. Therefore it has been necessary for litigation to begin with the initial request for an administrative hearing regarding the Districts issuance of a water withdrawal permit requested by Seminole County. The Florida Times Union began a series on the water withdrawal issue and will look at the facts involved.

Now You Will Know About Past Medical Malpractice

Justice has prevailed. As active members of the Florida Justice Association (FJA) we are proud that our four year legal battle has ended with victory on behalf of the citizens in this state. Hospitals and Doctors are now required to provide their complete history of medical errors to include permanent injury and death if requested. It is no accident that informed decisions save lives. You have the right to know about the medical facility and doctor that you are entrusting your life and well being with medically. The Florida Medical Association and Florida Hospital Association have waged a fierce battle for over four years to hide the truth. This ruling by the Florida Supreme Court takes away the refuge of the dark file cabinet containing records of the facts behind the misery caused by medical neglect and error.
